Terms of use
These terms cover your use of softdeck.com.au. Work we do for clients runs under a separate written agreement.
About these terms
These terms apply to your use of softdeck.com.au (the website), which SoftDeck Pty Ltd (ABN 90 656 203 477) runs. In these terms, "we", "us" and "SoftDeck" mean SoftDeck Pty Ltd, and "you" means the person using the website.
By using the website, you agree to these terms. If you do not agree, stop using the website.
Our privacy policy explains how we handle personal information.
Using the website
You may use the website to learn about SoftDeck and to contact us. You agree not to:
- break the law or infringe another person's rights
- try to gain unauthorised access to the website, our systems or other people's information
- introduce malicious code or disrupt the website or the servers that host it
- pretend to be SoftDeck or someone else
Content on the website
The website contains general information about SoftDeck, its services and topics such as AI and software. The information is not legal, financial, tax or other professional advice for your situation. Get advice from a qualified professional before you act on it.
Examples, case studies and outcomes describe past work and general capabilities. Results depend on your business, systems and data, and we do not guarantee any result.
We take care to keep the website accurate and current. We may change or remove content without notice.
Enquiries and the AI assessment
Sending an enquiry, an AI assessment submission or an email does not create a contract or a client relationship.
Suggestions, estimates and timeframes that we give before you accept a written proposal do not bind us.
Work we do for clients
We do client work under a written proposal, statement of work or services agreement. That document sets out the scope, fees, timing, ownership of the work and how we handle your information. If it conflicts with these terms, it takes priority for that work.
Intellectual property
SoftDeck and its licensors own the website content, including the text, design, graphics, illustrations, logo and code. Copyright and other laws protect it.
You may view the website and quote short extracts if you credit SoftDeck and link to the source page. Any other copying, republishing, adapting or commercial use needs our written permission.
Names, logos and screenshots of clients, tools and other businesses belong to their owners. Showing one on the website does not imply endorsement by that business.
Links to other websites
The website links to sites that we do not run. We do not control their content, availability or privacy practices, and a link does not mean that we endorse the site. Read a site's own terms and privacy policy before you use it.
Disclaimers
We provide the website and its content as they are. To the extent the law allows, we exclude warranties about them, including that the website will be available, free of errors or suitable for your purpose.
These terms do not exclude or limit a right, guarantee or remedy that the law gives you and does not allow us to exclude. That includes the consumer guarantees in the Australian Consumer Law, which is Schedule 2 to the Competition and Consumer Act 2010 (Cth).
Limits on our liability
To the extent the law allows, SoftDeck is not liable for loss or damage that arises from your use of the website, your reliance on its content or a link to another site. That includes indirect loss, consequential loss and loss of profit, revenue, data or opportunity.
If the Australian Consumer Law lets us limit our liability for breach of a consumer guarantee, we limit it, at our choice, to resupplying the services or paying the cost of resupply.
Changes to the website and these terms
We may change, suspend or remove any part of the website at any time. We may update these terms. The version on this page applies when you use the website, and the date at the top shows when we last changed it. If you keep using the website after a change, you accept the new version.
Governing law
The laws of New South Wales, Australia, govern these terms. You and SoftDeck submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
